LOYALTY MARKETING “WIN A BOTTLE OF GRANGE” PROMOTION

HOW TO ENTER

To be eligible to enter, individuals who receive a Loyalty Marketing business card with a unique code must log onto www.loyalty.com.au, follow the prompts as directed to the competition entry page, input the requested details and submit the fully completed entry form during the promotional period.

 

CONDITIONS OF ENTRY

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents aged 18 years and over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.

3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

4. Incomplete or indecipherable entries will be deemed invalid.

5. Only one entry permitted per unique code per person is permitted.  The same unique code cannot be used more than once.  Unrecognised codes will deem the entry invalid and will be discarded.

6. Promotion commences 01/05/09 and closes 9.30am on 29/04/10 (“Promotional Period”).

7. There will be one (1) draw conducted on 31/07/09, 30/10/09, 29/01/10 and 29/04/10. (“Draw Period”) (4 draws in total). Entries close at 9.30am AEST/AEDST (as the case requires) of the Draw Period.  All draws will take place at Loyalty Marketing, Suite 11, 210 Toorak Road, South Yarra, 3141 at 10am of the Draw Period.  Non-winning entries in each draw will be entered into any subsequent draws. Winners will be notified by mail and winners’ names will be published on www.loyalty.com.au. The Promoter’s decision is final and no correspondence will be entered into.

8. The first valid entry drawn from all entries received in each of the draws will win one bottle of Penfolds Grange Hermitage 2003 valued at $300 each. Any and all costs associated with attending the Event (including but not limited to airfares, transport, accommodation and meals) are the sole responsibility of the Participant.

9. Total prize pool is valued at $1,200.  The Promoter accepts no responsibility for any variation in the value of the prizes. All prizes are not transferable or exchangeable and cannot be taken as cash.

10. Any costs in excess of the value of the prize (including GST) and all ancillary costs associated with redeeming the prize are the responsibility of the winner. 

11. The Promoter encourages consumers to enjoy responsibly.  Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are (as at October 2001):

  • Males: Up to 6 standard drinks on any one day, no more than three days a week.
  • Females: Up to 4 standard drinks on any one day, no more than three days a week.

12. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

13. A draw for any unclaimed prizes may take place on 05/08/10 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners’ names will be published on www.loyalty.com.au  and in The Australian on 12/08/10.

14. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

15. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

16. If for any reason this promotion is not capable of running as planned (including but not limited to) computer virus, bugs, tampering, technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion subject to any written directions given by the various lottery departments, to cancel, terminate, modify or suspend the promotion.

17. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

18. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
